The Collegiate Learning Assessment Test has become popular and highly recommended, praised for its reliability and validity. I argue that while the CLA may be a commendable test for measuring critical-thinking, problem-solving, and logical-reasoning skills, those who are scoring students’ answers to the test’s questions are rendering the CLA invalid.

The Watson-Glaser Critical Thinking Appraisal Test is one of the oldest, most frequently used, multiple-choice critical-thinking tests on the market in business, government, and legal settings for purposes of hiring and promotion. I demonstrate, however, that the test has serious construct-validity issues, stemming primarily from its ambiguous, unclear, misleading, and sometimes mysterious instructions, which have remained unaltered for decades. Erroneously scored items further diminish the test’s validity. As a result, having enhanced knowledge of formal and informal logic could well result (...) in test subjects receiving lower scores on the test. The HCTA test is a recent addition to the commercially available array of critical-thinking assessment tests in higher education. After an introductory description of the test, I critically review it and conclude that, despite the fact that the HCTA is certainly well-intentioned, it has serious flaws with respect to its affordability, accessibility, and validity.

The CAT is entirely dedicated to assessing the critical-thinking skills involved in scientific reasoning and practical problem solving. While the test is found to have reasonable content validity, various issues with its prompts are discussed, along with significant issues with its scoring. The CAT’s recommended use as a “model” for curricular changes, called CAT Apps, is criticized as “teaching to the test.”.

On the nature of definitions and concepts, and the definition of critical thinking.

Some ways of teaching critical thinking seem destine to failure, e.g.,CT across the curriculum, and some obstacles to acquiring CT skills seem insurmountable, e.g., cognitive biases, but some approaches to teaching and learning to think critically, discussed in this article, can mitigate those biases and be demonstrably successful.

This article argues that xing 性 in the Zhuangzi 莊子 should not be understood as “human nature” but as “human condition.” It introduces the problem of interpreting xing as “human nature” by surveying relevant English-language literature before detailing the interpretive paradigm of Chinese accounts showing how the latter’s appropriation of the language of substance ontology hinders an accurate portrayal of Daoist xing. It argues that xing should be interpreted in connection to the concept of ming 命understood as contingent, natural, and (...) temporal “external conditions”. It argues that xing are “internal conditions” that function in conjunction with ming as “external conditions” where “habit” (xi 習) mediates their interaction. (shrink)

In this dissertation, I defend an interpretation of the methodological development of transcendental philosophy from Kant's first Critique to Fichte's later Jena-period Wissenschaftslehre. Both Kant and Fichte claim that experience is founded upon certain a priori subjective structures and capacities. However, I argue that the methodology of Kant's first Critique includes a number of assumptions and explicit doctrines that limit his ability to explain experience. The chief problem of Kant's theory of method is, I claim, his distinction between the methods (...) of philosophy and mathematics, whereby the method of construction is limited to mathematics. I argue that Fichte attempts to solve Kant's problem by expanding the method of construction to philosophy itself. As a method, construction has two aspects. First, the task of the philosopher is to reconstruct discursively the spontaneous process whereby subjectivity is self-constructing. By "self-construction," I refer to a functional structure wherein subjectivity is the achievement of a range of proto-conscious, primitive mental activities. Second, the method of the philosopher is similar to the method of geometric construction, viz., the postulation of a task to be completed regarding which one---beginning from putatively self-evident resources---creatively and imaginatively seeks out a solution. Fichte turns to construction since there is no algorithm for philosophical reflection and he revises Kant's important doctrines regarding intellectual intuition and the productive imagination. However, though Fichte's solution to Kant's problem is promising, the notion of construction itself generates a number of problems. (shrink)

Most philosophers have largely downplayed any relevance of multiple meanings of the folk concept of truth in the empirical domain. However, confusions about what truth is have surged in political and everyday discourse. In order to resolve these confusions, we argue that we need a more accurate picture of how the term ‘true’ is in fact used. Our experimental studies reveal that the use of ‘true’ shows substantial variance within the empirical domain, indicating that ‘true’ is ambiguous between a correspondence (...) and a coherence reading. We then explore the consequences of these results for the project of re-engineering truth. (shrink)

Processes of adapting complex information for broad audiences became a pressing concern by the turn of the twentieth century. Channels of communication ranged from public lectures to printed books designed to serve a social class eager for self-improvement. Through analyzing a course of public lectures given by George Howard Darwin (1845–1912) for the Lowell Institute in Boston and the monograph he based on these, The Tides and Kindred Phenomena of the Solar System (1898), this article connects the important practices of (...) public lecturing and book production–two aspects of knowledge dissemination that tend to be studied as separate entities. Darwin, Plumian Professor of Astronomy at the University of Cambridge and son of the famous naturalist, relied on a diverse material culture when lecturing and producing a book. Giving a new account of Darwin’s scientific work through exploring his adaption of it for broader audiences, this article connects the diverse material culture Darwin employed in talks to the practice of producing a published book. The content of objects demonstrated and the lantern slides projected during Darwin’s lectures evolved to form a book designed to engage broad sectors of society in Europe and the United States. Darwin’s lectures were attended at full capacity, while The Tides was soon printed in numerous English editions and translated into German, Italian, Hungarian, and Spanish. (shrink)

Husserl seems to have devoted roughly equal amounts of energy and pages to the description of perception, judgement, and imagination. By “description,” he meant the analysis of the traits and components of mental states or acts and their objects. As his views changed over the years about the nature of intentionality and philosophy, the descriptive psychology of the Logical Investigations (1900/01) gave way to descriptive programmes in which the objects of perception and of judgement were conceived of in terms of (...) a new, analytic framework; in particular Husserl lost interest in describing the things and processes in the real world that are the objects of perception and judgement and so too in describing their relations to these acts. His new analytic framework, particularly as it applies to perception, has been thoroughly expounded and discussed in the literature. My aim here is to expound Husserl's first descriptions of perception within the framework of the Investigations and to incorporate as far as possible his later descriptive results to the extent that these are separable from his later turn to idealism. Justifying religious exemptions is a complicated matter. Citizens ask to not be subject to laws that everyone else must follow, raising worries about equal treatment. They ask to be exempted on a religious basis, a basis that secular citizens do not share, raising worries about the equal treatment of secular and religious citizens. And they ask governmental structures to create exceptions in the government’s own laws, raising worries about procedural fairness and stability. We nonetheless think some religious exemptions are appropriate, (...) and in some cases, that exemptions are morally required. So how are we to determine when religious exemptions are justified? This article employs a public reason framework to provide an answer. I show how to publicly justify religious exemptions. My thesis is that a citizen merits a religious exemption under four conditions: if she has sufficient intelligible reason to oppose the law, if the law imposes unique and substantial burdens on the integrity of those exempted that are not off-set by comparable benefits, if the large majority of citizens have sufficient reason to endorse the law, and if the exempted group does not impose significant costs on other parties that require redress. If these conditions are met, then legislative and/or judicial bodies should carve out an exemption for those requesting them. (shrink)

Within legal scholarship and practice, among the most pervasive tasks is the interpretation of texts. And within legal interpretation, perhaps the most pervasive inquiry is the search for “ordinary meaning.” Jurists often treat ordinary meaning analysis as an empirical inquiry, aiming to discover a fact about how people understand language. When evaluating ordinary meaning, interpreters rely on dictionary definitions or patterns of common usage, increasingly via “legal corpus linguistics” approaches. However, the most central question about these popular methods remains open: (...) Do they reliably reflect ordinary meaning? This Article presents a series of experiments that assess whether (a) dictionary definitions and (b) common usage data reflect (c) how people actually understand language today. -/- The Article elaborates the implications of two main experimental results. First, neither the dictionary nor legal corpus linguistics methods reliably track ordinary people’s judgments about meaning. This shifts the argumentative burden to jurists who rely on these tools to identify “ordinary meaning” or “original public meaning”: these views must articulate and demonstrate a reliable method of analysis. Moreover, this divergence illuminates several interpretive fallacies. For example, advocates of legal corpus linguistics often contend that the nonappearance of a specific use in a corpus indicates that the use is not part of the relevant term’s ordinary meaning. The experiments reveal this claim to be a “Nonappearance Fallacy.” Ordinary meaning exceeds datasets of common usage — even very large ones. -/- Second, dictionary and legal corpus linguistics verdicts diverge dramatically from each other. Part of that divergence is explained by the finding that broad dictionary definitions tend to direct interpreters to extensive interpretations, while data of common usage tends to point interpreters to more prototypical cases. This suggests two different criteria that are often relevant in interpretation: a more extensive criterion and a more narrow, prototypical criterion. Although dictionaries and corpus linguistics might, in some cases, help us identify these criteria, a hard legal-philosophical question remains: Which of these two criteria should guide the interpretation of terms and phrases in legal texts? Insofar as there is no compelling case to prefer one, the results suggest that dictionary definitions, legal corpus linguistics, or even other more scientific measures of meaning may not be equipped in principle to deliver simple and unequivocal answers to inquiries about the so-called “ordinary meaning” of legal texts. Scholarship in experimental jurisprudence has reported surprising findings about various concepts of legal significance: _acting intentionally_, _causation_, _consent_, _knowledge, recklessness_, _reasonableness,_ and _law_ itself. Often, these studies examine laypeople’s ordinary concepts and draw broader conclusions about legal experts’ concepts. This Article questions such inferences, from empirical findings about ordinary concepts to conclusions about the concepts of those with legal expertise. It presents a case study concerning what it means to act _intentionally._ An experiment examines intentionality judgments across four populations (N (...) = 774): laypeople, law students, non-law students, and United States judges. Legal training affected judgments in three ways that are consistent with the acquisition of a distinctive legal concept. This case study supports the Article’s broader claim: Laypeople’s ordinary concepts are not equivalent to experts’ legal concepts. The acquisition of legal concepts is an important form of legal expertise. (shrink)

This paper reports on an exploratory, qualitative study of media use among Syrian refugees in Turkey, focusing on two locations: a refugee camp in Sanliurfa and a community center in Istanbul. It seeks to provide new angles for conceptualizing the “connected refugee” by adopting a non-media-centric and ethnographic approach that emphasizes diversity, local contexts and everydayness. Firstly, the paper discusses the interplay between individual and collective ownership of media and ICTs, which is linked to certain power dynamics and an informal (...) economy of solidarity. I examine the positive and negative features of homeopathy from an ethical perspective. I consider: (a) several potentially beneficial features of homeopathy, including non-invasiveness, cost-effectiveness, holism, placebo benefits and agent autonomy; and (b) several potentially negative features of homeopathy, including failure to seek effective healthcare, wastage of resources, promulgation of false beliefs and a weakening of commitment to scientific medicine. A utilitarian analysis of the utilities and disutilities leads to the conclusion that homeopathy is ethically unacceptable and ought to be (...) actively rejected by healthcare professionals. Psychotherapy helps one enact ideas about a good life, and therapists practice orientations rooted in their chosen approach. A 'good life' can therefore mean different things depending on the therapy. Building on the philosophy of Charles Taylor, Smith examines the link between therapy, ethics and the root of therapeutic views in comparison to modern, Western ideas about 'living well'. I examine the positive and negative features of synthetic biology (‘SynBio’) from a utilitarian ethical perspective. The potential beneficial outcomes from SynBio in the context of medicine are substantial; however it is not presently possible to predict precise outcomes due to the nascent state of the field. Potential negative outcomes from SynBio also exist, including iatrogenesis and bioterrorism; however it is not yet possible to quantify these risks. I argue that the application of a ‘precautionary’ approach to SynBio is ethically (...) fraught, as is the notion that SynBio-associated knowledge ought to be restricted. I conclude that utilitarians ought to support a broadly laissez-faire stance in respect of SynBio. (shrink)

_The Physiological Basis of Behaviour_ deals with the basic structures of the central nervous system, the techniques used in neuroscience and examnines how drugs affect the brain.

Cognitively disabled individuals have been marginalized by our larger culture; they’ve also been marginalized in philosophical discussions. This paper seeks to begin correcting this situation by examining how assumptions which shape our social interactions and expectations disadvantage individuals with a range of cognitive disabilities. After considering Rubella syndrome and autism in detail, I argue that we have a moral obligation to change how we approach social interactions with cognitively disabled individuals.
